Plaintiff brought this action against the United States pursuant to the Federal Tort Claims Act, 28 U.S.C. 1346(b) and 2671-80, for the wrongful death of decedent, Ben Johnson. Plaintiff sought to recover damages from the United States alleging the National Park Service was negligent in undertaking the rescue of decedent.
